(53) As consumers and undertakings are not in the same position, they do not need the same level of protection. While it is important to guarantee consumer rights by provisions from which it is not possible to derogate by contract, it is reasonable to let undertakings and organisations agree otherwise when they are not dealing with consumers. However, Member States should be able to provide that microenterprises, as defined in Commission SME Definition Recommendation ( 16 ) , be treated in the same way as consumers. In any case, certain core provisions of this Directive should always apply, irrespective of the status of the user.
