(35) In the interests of consumer choice and in order to encourage innovation, research and easy access to new technologies, the existence or subsequent placing on the market of a better product should not in itself lead to the conclusion that a product is defective. Similarly, the supply of updates or upgrades for a product should not in itself lead to the conclusion that a previous version of the product is defective.
